Construction Section & ADR Section Joint CLE

Topic: An Insider’s View of Construction ADR: Effective and Ineffective ADR Advocacy from the Perspective of an Experienced Mediator/Arbitrator
Speaker: Thomas W. Myers, Andrews Myers P.C.

This CLE will educate construction law advocates on practices that are effective or ineffective in mediation and arbitration proceedings and identify issues, procedures and practices that are traps to be avoided.

  • Significant changes in construction arbitration practice from the 80’s to today; current scope of American Arbitration Association’s administration of cases in Texas
  • Mediation practice: best practices that lead to successful mediation; worst practices that waste time and resources and invite failure of the process
  • Arbitration: the preliminary hearing; key procedural rules that may trap the unwary; evidence and other oral hearing pitfalls; Arbitrator disclosures
  • Mediation/Arbitration: pros/cons and review of an actual med/arb agreement
