Topic: After the Handshake Deal: Proving What’s Not in Writing

Litigators Brent Turman and Mike Farris walk through a jury trial in which they proved that, despite the lack of a written agreement, their client was a partner in the venture that originally published the “Fifty Shades of Grey” trilogy. Tax-related issues and the formation of entities played a large role in proving a partnership existed and determining the value of the partnership. Through the discovery process, Farris and Turman had to un-tangle the web of corporate structures the foreign-based defendant created when money started coming in the door. Moreover, at trial, tax-related documents played a large role in both proving partnership by conduct and assisting plaintiff’s expert in preparing a valuation for the partnership. n.
