Understanding the three points of the arbitral decision-making model—strictly applying the law, strictly applying the contract, and seeking fairness—and how an arbitrator approaches these matters can aid construction law practitioners in how they approach contract drafting and negotiation and advocacy. The presentation will provide background on the three points of this model, and offer practical insight on the effect that they have in deciding the outcomes of disputes.
