Most attorneys are scared or angry (or a combination of both) when they find out that their former client has filed an application for writ of habeas corpus alleging ineffective assistance of trial counsel. Usually, these emotions stem from not fully knowing what a finding of ineffective assistance on one’s record would mean, and in response, attorneys often throw their former client under the bus in a desperate effort to defeat the writ. In this course, I’ll discuss the best practices for responding to an ineffective assistance claim, demystify the possible penalties you could face, and offer advice on how to protect yourself, possibly without wrecking your past client’s ability to obtain some relief from their conviction.
