Join the Civil Litigation Section for an evening of networking and ethics CLE at Scott Douglass & McConnico! Wine and light snacks will be provided.
In this CLE presentation we will examine several topics that concern and arise in legal malpractice claims. We will discuss the following topics: 1) an attorneys' fiduciary duty to their clients, 2) the legal remedies available against a lawyer if a lawyer violates their fiduciary duties to their clients, 3) the history of the Arce Case attorney fee forfeiture rule in Texas, 4) the statute of limitations on negligence and breach of fiduciary duty claims against attorneys, 5) attorneys' duty when they represent multiple clients in the same case, 6) an attorney’s duty of confidentiality under Lawyer Ethics rule 1.05, 7) the requirement, under Texas law that there be privity between an attorney and client if the client wants to sue the attorney for negligence and 8) the new lawyer advertising rules that went into effect in July of 2021.
